Agreement to Terms
By booking a ride, tour, or using any related services provided by Zhane’s Taxi Services (“ZTS,” “we,” “us,” “our”), including our website, booking forms, communications, and transportation offerings (collectively, the “Services”), you (“you,” “your,” “Client”) agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you must not use the Services.

Services & Scope
2.1 We provide private taxi transfers, airport pick-ups, island tours, and related transportation services within Antigua & Barbuda.
2.2 Each booking request or confirmation email outlines the details of the Service, including pricing, pick-up information, passenger requirements, and add-on requests.
2.3 We may update or modify the Services at our discretion, with notice where required.

Client Responsibilities
3.1 You agree to provide accurate booking information, including passenger count, pick-up details, flight details (if applicable), and special requirements.
3.2 You must ensure passengers—especially minors—comply with safety laws, including seatbelt and car seat use.
3.3 Services may not be used for unlawful, unsafe, or improper purposes.

Fees, Payment & Billing
4.1 Fees are based on the pricing displayed on our website and booking forms.
4.2 Prices are in USD; we accept USD, XCD, and major credit cards.
4.3 Payment is due at the end of the trip unless otherwise agreed.
4.4 Promotions may be modified or discontinued at any time.

Transportation Services, Scheduling & Acceptance
5.1 We strive to be on time, but delays may occur due to traffic, weather, or unforeseen conditions.
5.2 You must be ready at the scheduled pick-up time. Client delays may incur fees.
5.3 Route changes or additional stops may result in additional charges.

Cancellations, Delays & Rescheduling
6.1 Cancellations at least 24 hours in advance are free.
6.2 Cancellations within 24 hours may be charged the full fare.
6.3 Flight delays are monitored; reasonable delays do not incur extra charges.
6.4 If we must cancel for safety, weather, or operational reasons, we will reschedule or refund where applicable.

Safety, Conduct & Restrictions
7.1 Passengers must follow safety instructions, including seatbelt use.
7.2 Car seats and boosters are available upon request for a fee.
7.3 We may refuse service to anyone engaging in unsafe, illegal, or aggressive behavior.
7.4 Smoking, illegal substances, and vandalism are strictly prohibited.

Limitation of Liability
8.1 ZTS is not liable for indirect or consequential damages, including missed flights or delays.
8.2 Liability is limited to the amount paid for the Service.
8.3 Nothing excludes liability for personal injury or death caused by negligence.

Termination of Service
9.1 Either party may cancel a booking if the other breaches these Terms.
9.2 We may suspend Services immediately for misuse, unsafe behavior, fraud, or unpaid fees.
9.3 Upon termination, outstanding balances must be paid.

Data Use & Privacy
Your use of the Services is subject to our Privacy Policy. You consent to the collection and use of personal information necessary to provide transportation services, including communications via WhatsApp, email, or phone.

Changes to Terms
We may update these Terms periodically. Updated versions will appear on our website with a new “Last Updated” date. Continued use of the Services means you accept the updated Terms.

Governing Law & Dispute Resolution
These Terms are governed by the laws of Antigua & Barbuda. Disputes must be handled in Antigua & Barbuda courts unless both parties agree otherwise.

General Provisions
13.1 Assignment: You may not transfer your rights without our consent.
13.2 Severability: Invalid clauses do not affect the remaining Terms.
13.3 Waiver: Failure to enforce a right does not waive future enforcement.
13.4 Entire Agreement: These Terms, your booking confirmation, and our Privacy Policy make up the full agreement.
